Vibhav Mithal talks about the recent order of the Hon’ble Delhi High Court setting timelines at the stage of final arguments.

He cites the recent case of Roland Corporation v Sandeep Jain CS (COMM) 565/2018 in which the Plaintiff sought Case Management hearing during the final stages of arguments which was already listed for 10th April 2019. It may be worth mentioning that the provision of Case Management hearing is applicable to commercial disputes of a specified value. The Hon’ble High Court was pleased to pass an order on 19th January 2019 binding the Plaintiffs to the mentioned time limit. The Court further held that if need be, it may also limit the time for addressing oral arguments on behalf of the Defendant.

The order is unique as:

  • It uses the case management provision in the Code of Civil Procedure introduced by the Commercial Courts Act 2015.
  • Moreover, the very fact that timelines were set at the stage of final arguments is unique in itself.
