Application Number : 9325/DELNP/2007

During examination the patent office objected that application was within the scope of Section 4 of the Indian Patent Act and Sub-section 1 of Section 20 of the Atomic Energy Act, 1962 as the subject matter of instant application relates to A catalyst deposited on the carrier in addition to silver, one or more further elements selected from the group of nitrogen, sulfur, phosphorus, boron, fluorine, Group IA metals, Group IIA metals, rhenium, molybdenum, tungsten, chrontium, titanium, hafnium, zirconium, vanadium, manganese, thallium, thorium, tantalum, niobium, gallium and geimaiuum and mixtures thereof. The weight per cent mention in Atomic Energy Notification category 0A303. So it was proposed to send the matter to Atomic Energy for clearance.

Objection under Section 4 was raised, which  Anand and Anand successfully overcame based on written submissions and representations made before the Department of Atomic energy (DAE). Granted without a hearing.

Significance: Atomic Energy-related Inventions not allowed in India or are significantly delayed. Anand and Anand was able to get a patent grant with their submissions.
